Terms and Conditions

Set out below are the full Terms and Conditions for the sale of all products made and supplied by Supercakes.

By paying the deposit, it will be deemed that these terms and conditions have been fully understood and accepted as applying to the order from the client.

Nothing contained within these terms and conditions affects the statutory rights of the client as a consumer.

If there is anything that the client does not understand, then Supercakes should be contacted for clarification.

Payment Conditions

Prices

The price for the order shall be as stated on the client’s order form and is non-negotiable. It is priced according to the exact design and size of the cake ordered.

The client will agree to pay the full price as stated on the order form after the details have been checked, agreed and signed by them.

We do not ‘price match’, as our prices are based upon our high standard of work and quality of ingredients used.

Following the initial enquiry and subsequent consultation with the client, Supercakes shall provide a quotation which will be valid for 60 days. Payment of the deposit by the client (see ‘Deposits’) will secure the order and shall prevent any price increases during this period, except in unusual circumstances beyond our control (e.g. exceptional fuel price increases, flower price increases, ingredients price increases, etc.).

Deposits

All wedding cake orders will require a deposit of £100.00.

All other celebration cake orders will require a minimum deposit of £10.00.

These payments made to Supercakes will be required to secure the commission of the cake and the chosen collection / delivery date to the client and/or venue.

All deposits become due when the order has been placed and details have been checked and agreed by the client.

All orders are deemed to have been accepted only when the deposit has been paid to Supercakes.

Please note that all deposits are non-refundable and non-transferable.

Payment

Payment may be made by bank transfer on application of the bank account details of Supercakes.

An email should be sent to info@supercakes.co.uk to confirm the transfer of funds in order to prompt acknowledgement of the payment by return.

Final payment for the client’s wedding cake will be required no later than 7 days before the collection / delivery date agreed.

It shall be the responsibility of the client to arrange this payment within the time specified as a reminder invoice will not be issued.

If the client prefers to make payment by cheque then it should be made payable to ‘Diane Fry’.

Alternatively, payment may be made by Cash or directly into our PayPal account (provided on request).

Unfortunately, we are unable to accept debit, credit or charge cards.

Final Payments

Final payments for all wedding cake orders placed must be made at least 7 days prior to the collection / delivery / set-up of the cake or as stated on the order form.

Payments for all other celebration cakes can be made at the time of collection by cash or cheque.

Late Payments

If the client’s deposit is not paid within 60 days of the date of the quote then we reserve the right to cancel any previous arrangements.

Non-Payments

If a payment made is subsequently declined by our Bank, the order will not be completed or released until an alternative funding arrangement has been agreed and payment is made in full.

Following this situation, the order may be subject to delay and completion will be subject to availability and cannot be guaranteed.

Supercakes shall not accept responsibility for any loss howsoever caused or for non-delivery of an order under these circumstances.

The client shall be responsible for the payment of any additional charges which have been incurred by Supercakes as a result of payment failure.

Order Cancellation and Refunds

Cancellation of a Wedding Cake and/or Special Order

As the wedding cake and/or special order booking is reserved solely for a specific client and certain components / accessories for the cake(s) may be ordered months in advance, the following conditions shall be implemented when an order is cancelled.

a.6 months from delivery date – 50% of the total order value will be payable.

b.0 to 3 months from delivery date – 100% of the total order value will be payable.

c.Wedding Cake and Special Order cancellations must be made in writing to Supercakes.

Cancellation of other Celebration Cake Orders

If the event is cancelled and the cake(s) will not be required, Supercakes reserves the right to retain the 25% deposit.

If cancellation takes place 21 days before the event then Supercakes reserves the right to keep 50% of the total value of the order.

If cancellation takes place within 7 days of the event then Supercakes shall retain 75% of the total value of the order to cover the costs of production of the cake.

Cancellation of the order must be made in writing (by letter or email) to Supercakes and will only be deemed to take effect from the date the letter or email is received at our premises.

If the event is postponed, we shall endeavour to re-schedule the order providing the revised date is suitable for ourselves. Otherwise, the order shall be treated as a cancellation (see above).

We retain the right to cancel the order booking in the event of unusual circumstances beyond our control (e.g. fire at our premises, ill health of our staff). In these situations, we shall refund in full all monies taken.

Alterations and Changes

The production of a cake for a client is very important to us. The client should check their copy of the order form carefully and advise Supercakes if any changes are required to the original order within 3 days of placing the order.

If a change is requested by the client, then Supercakes will endeavour to change the design where possible, but occasionally this may not be possible due to the nature of the request or amount of notice given.

If the change(s) requested affect the preparatory work for the original design already been undertaken, then Supercakes reserve the right to adjust the cost of the order accordingly.

The client should warn Supercakes if they are undecided on the design of the cake(s) when paying the deposit.

Note. Whilst every effort will be made to assist a client, late changes cannot always be guaranteed.

Supercakes reserves the right to change the design at any point if circumstances, which are beyond their control, could possibly compromise the quality of the finished cake (e.g. melting due to weather conditions).

Note. Each cake is individually made by hand, so although every effort is made to ensure consistency, a small amount of variation may occur from any picture / diagrams supplied by the client.

Cake Component Parts

Occasionally, certain accessories / materials for celebration and wedding cakes may no longer be available from our suppliers or will have become obsolete (e.g. pre-manufactured items or ribbon colours). This situation is totally beyond the control of Supercakes. In these circumstances, Supercakes will liaise with the client and endeavour to re-design a cake to reflect, as closely as possible, the original design using alternatively available products.

Supercakes reserves the right to replace the component parts with equal or better quality without consultation.

Design Conditions

Chocolate

Supercakes recommends extreme caution if a client requires a cake decorated with chocolate intended for a summer event (i.e. May to September).

Supercakes cannot accept any responsibility for any melting of the cake after it has left our premises since we have no control over the environmental conditions at the venue in which it will be placed.

Supercakes can offer advice for designs of cakes which would be less susceptible to melting and will make every effort within their control to reduce the detrimental effect on the cake.

Home Baked Fruit Cakes

Supercakes understands that there is a sentimental significance in having a member of the family bake a fruit cake to which the client subsequently requests that Supercakes apply the icing and / or decoration.

Supercakes will be pleased to provide this service for fruit cakes (but not sponge cakes). However, cakes provided for this service must conform to strict guidelines so that an appropriate finished look can be achieved and the end result will not be disappointing.

Unless otherwise required for the design, the cake should be a minimum of 3” deep, Supercakes cannot be held responsible for any flaws which are a result of the cake not being baked by themselves.

The client should consult with Supercakes prior to baking their own cake in these circumstances.

Flowers

Supercakes do not recommend the use of fresh flowers on any edible surface due to the nature of any pesticides etc which may have been used during their growth. Therefore, if the client wishes to use fresh flowers then the client will be held responsible for any illness caused in this respect. Supercakes can provide special perspex cake tier stands which entirely encapsulate the flowers which will then not cause any detriment to health.

Handmade flowers made in a special icing mix which will last for years, and which can be coloured to match any colour or shade are available from Supercakes upon request.

Viewing

Due to their nature, cakes with sponge tiers and cupcakes may not be completed until the day of the event / celebration. This is to ensure the cakes will be as fresh as possible.

Viewing of any wedding cakes ordered should be pre-arranged with Supercakes.

Allergies and Special Dietary Requirements

Allergies

The client should be aware that whilst the cake ordered by them may not be made with nuts or any nut based product, it will be prepared in a kitchen where nut based products may be used in other cakes and fillings.

Raw ingredients used may not be free from dairy, wheat or gluten.

Allergy information is provided by Supercakes to clients for all cake orders received.

Special Diets

The client should discuss with Supercakes if any guests at the event have special dietary requirements. Cakes can be made gluten free, egg free, alcohol free and nut free by request. (See ‘Allergies’ above)

Non-Edible Items

Most cakes which are made for clients contain small quantities of inedible items (e.g. support dowels in tiered cakes, ribbon, support wires in sugar flowers, Swarovski crystals, flower picks and flower tape. It shall be the responsibility of the client to ensure that these items are removed by the caterer or guests prior to consumption of the cake.

Delivery Conditions

Personal Collection

All orders may be collected by the client personally from the premises of Supercakes at a pre-arranged time, agreed at the point of order.

A signature will be required from the client when collecting their order to confirm that the cake has been received in perfect condition and all details are as specified on the original order form.

Supercakes will not be held liable for any damage to the cake once it has left their premises.

Tiered cakes (e.g. wedding cakes) are most at risk during transportation. Supercakes should be consulted regarding the best method of transport.

Supercakes recommends that the client should check that wedding insurance covers cake damage.

To ensure that the cake is as fresh as possible, Supercakes recommends that it is collected the day before or on the day of the event.

Any late requests for delivery will be accommodated where possible, but cannot be guaranteed, as earlier delivery commitments must take priority.

Delivery

Supercakes are able to offer a personal delivery service to any client or venue within a 15 mile radius of Swindon, Wiltshire.

Delivery to the remainder of the UK mainland will be by courier. When the order is delivered by courier, the client should check the cake(s) before signing the delivery receipt. It shall be the responsibility of the client to claim from the courier for any damages to the cake(s).

Prior arrangement may be made between the client and Supercakes for delivery to the client / venue of the order.

All delivery times will be subject to availability.

If the client requires a specific delivery date, time and location, then this should be stated on the order form. Supercakes will do their best to accommodate the requirements of the client.

It shall be the responsibility of the client to provide the correct delivery information (i.e. date, time, location, etc.) and arrange for someone to receive and sign for the order. A contact telephone number for the client is essential.

If the recipient is absent at the time of delivery, then the courier will make all efforts to contact the client or recipient,the delivery is not able to take place, then the order shall be returned to Supercakes premises and they will contact the client to make alternative delivery arrangements. This re-arrangement will incur an additional charge to be paid by the client upon delivery.

Supercakes will not accept responsibility for any loss or consequential loss incurred by the client as a result (e.g. wedding ceremony without a wedding cake).

Note. A delivery charge calculated on a mileage and time basis will be added to the order form.

If the client requires the cake to be delivered then it is the policy of Supercakes that it will be delivered in perfect condition prior to the start of the event.

However, Supercakes requests that the client will allow for factors beyond their control (e.g. traffic and / or weather conditions). Supercakes cannot be held liable for any such delays.

In certain circumstances, Supercakes recommends that the cake is delivered the day before the required date.

It shall be the responsibility of the client to advise Supercakes of the correct event, date, time and full address (including postcode) of the location. In the unlikely event of late delivery, the maximum compensation to the client from Supercakes will be a refund of the delivery price.

Cake Set-up

If the cake is to be delivered and set-up at the venue of the event then Supercakes can provide this service as agreed on the order form.

Supercakes will want to ensure that the cake is displayed at its best. It shall be the responsibility of the client to ensure that Supercakes have been provided with the set-up details and that arrangements have been made with the venue for the location and display of the cake.

Supercakes cannot be held responsible for the location of the cake at the venue.

It shall be the responsibility of the client to ensure that all arrangements have been made for the provision of a cake table, linen, cake stand and knife, which should all be set-up prior to delivery of the cake. If any delay is incurred due to these items not having been set-up then Supercakes reserves the right to charge a fee (i.e. labour costs at £25/hour) plus any compensation required to be paid to other clients whose cake deliveries have been delayed as a result.

Alternatively, the cake may be left with the client’s Event Manager to set-up/assemble/move into position as appropriate. In this situation, Supercakes will not be held responsible for any damage to the cake and/or not adhering to the wishes of the client.

The client should ensure that the location of the display is level, stable and strong enough to support the cake.

Note. In the case of a marquee wedding, any surrounding floor boards can easily rock the cake and table when stood on due to uneven ground.

Once the cake has been collected by the client or delivered by Supercakes, set-up and signed for, we are unable to accept liability for any interference with or damage to the cake thereafter.

If a cake is to be delivered and set-up by Supercakes, a signature will be required from the management of the venue confirming that the cake has been received and set-up in good condition.

A photograph of the cake in its location will be taken by Supercakes prior to their departure to verify that the cake has been set-up and left in good condition.

Storage and Consumption

Portion Guide

Supercakes can provide a portion guide to their clients to aid a decision for the size of cake required relative to the number of guests who will be attending the event. Please see our website.

Note. These portions will vary according to how the chef / venue cuts the cake.

Best Before Date

Supercakes will bake a cake to ensure that it is fresh for the date of the event. After this date, it is recommended that sponge cakes are frozen as soon as possible to ensure that their condition is retained. Supercakes cannot guarantee the quality of its cakes if they are consumed more than 48 hours after the event.

The cakes baked by Supercakes are made entirely from natural ingredients. This means that they will not have the extended shelf life of most cakes available from supermarkets which contain additives and preservatives and which specify ‘Best Before’ dates.

Freezing a cake preserves the taste of the sponge and icing as much as feasibly possible, but it should be noted that this will affect the visual appearance of the icing since condensation will form upon defrosting.

Note. Food hygiene recommendations advocate that food should only be frozen for a maximum of 3 months.

Rich fruit cakes are best stored in plastic air tight containers, (not cake tins). Do not wrap in ‘tin foil’ prior to storage. Due to the amount of alcohol used in the baking process, any rich fruit cakes stored in this way, they will last for many months, although the icing may go very soft.

Storage Conditions

It is the policy of Supercakes to remove all cake boxes from the venue following cake set-up to ensure the displayed area is left as tidy as possible.

If a client intends to keep any of the original tiers of a cake, then Supercakes should be advised regarding what cake boxes should be left at the venue for subsequent safe cake transportation following the event.

When the unused portions of a cake have been brought home, they should be wrapped in cling film to remove as much air as possible. They should then be stored in an air tight container before freezing for a maximum of 3 months. (see Best before Date regarding storage of rich fruit cakes)
Rather than store the unused cake as a whole, it may be more convenient for it to be cut into appropriate sized portions before freezing. This is so that the cake can be defrosted on a ‘per portion’ basis since cake should not be refrozen if defrosted.
Cakes decorated using sugar paste should not be refrigerated as this will cause condensation to form on the surface of the icing. Refrigeration also accelerates the staling of the flour in the cake, so should only be used with extreme caution (e.g. if hot weather is compromising the quality of a cake decorated with chocolate).

Loan of Cake Stands / Accessories

Supercakes can provide cake stands, cake knives and other appropriate cake-related decorations and accessories for loan at the event. A deposit, in the form of a separate cheque, will be required and will vary according to the value of the item being loaned and will be discussed at the time of the cake order. The deposit cheque will be required at the time of the cake order. The hire charge will be agreed and become payable at the time of the order being placed.

The client should make arrangements for the items to be collected within 2 days of the event and to be safely returned to Supercakes in a clean condition within 2 days after the event.

If the item(s) cannot be returned in person, then the client should ensure that it is / they are appropriately packaged to prevent damage and returned to Supercakes at the client’s cost. Supercakes recommends that plenty of bubble wrap be used, securely taped around the item(s) and be placed in a sturdy box to prevent damage against drops and knocks during transportation.

If the item(s) loaned are left at the venue for the Event Manager to return or Supercakes to collect, then the client’s deposit will be returned following safe receipt of the item(s).

Complaints

If the client has any concerns about the cake received, then Supercakes should be notified immediately upon delivery / inspection so that the opportunity to rectify the problem may be made before the event.

Supercakes recommends that a member of the family / Event Manager be designated as the point of contact for Supercakes so that all dealings relating to the cake run smoothly on the day.

All other concerns should be made in writing to Supercakes and any evidence of the issue causing concern should be provided.

Any refunds are only given if the unconsumed cakes are returned and are either unsuitable for consumption or not as described in the original written quotation.

No refunds are given due to ‘a change of mind’.

In the unlikely event of late delivery of the cake(s), which is defined for example, ‘after the start of the wedding breakfast’, Supercakes will provide a maximum compensation in the form of a refund of the delivery price.

Publication and Promotional Rights

By signing the Order Form, the client agrees that the proprietor of Supercakes is the sole designer and owner of the final cake design.

All rights in any original designs created and designed by Supercakes shall remain the exclusive property of Supercakes.

Periodically, our cake designs may be published in the media (e.g. Wedding Magazines or on the Internet). We reserve the right to use any image of a client’s cake made by Supercakes for publication after the delivery date unless previously agreed in writing between the client and ourselves.

The client will have no ownership rights over any cake design.

Exclusivity of cake designs between clients of Supercakes is not guaranteed unless the client commissions an exclusive design.
